This process, called "discovery," usually does not involve the judge. However, if one side refuses to comply with a discovery request, then the party who made the request can file a Motion to Compel with the court. In order to oppose the motion, you should identify your reasons for not complying and draft a Motion in Opposition. EditDrafting Your Motion in Opposition - Read the motion to compel. You should receive a copy of the other side's motion that was filed with the court. This motion should identify the discovery you haven't produced and explain why the other side is entitled to it.
- As soon as you receive this motion, read it carefully. You need to fully understand the arguments made.
- If you have a lawyer, then the motion was served on your lawyer. Ask for a copy.
- Check your local rules for the deadline. Your court's local rules should tell you how much time you have to respond to the motion and any required information that you must include in your motion in opposition.[1] Your local rules should be posted to the court's website.
- Identify your reasons for not complying. You need to give the court a reason to deny the other side's motion to compel. There are many different reasons you could give. Take out your Response to the discovery request. You should have identified reasons in your Response for why you weren't turning over certain information. Depending on your circumstances, you could claim the following:
- You have actually complied with the discovery request. For example, the other side might have served requests for production of emails relating to a topic.[2] You might have provided all relevant emails.
- The other side isn't entitled to the discovery. A party can only request discovery if it is relevant to the lawsuit. If the requested information wasn't relevant, then you might not feel they are entitled to it.
- The discovery request was too vague or ambiguous. You can't respond to a request that you don't understand.
- The document is privileged. There are many privileges, but the attorney-client privilege is most important. If you made a confidential communication to your lawyer for the purposes of obtaining legal advice, then the communication is protected from disclosure.[3]
- Format your document. To begin drafting your Motion in Opposition, you should open up a blank word processing document. Set the font to a legible size and style. Generally, Times New Roman or Arial 14-point font works best. Make sure the margin is at least one inch.[4]
- Check your previous documents filed in the case and follow the formatting. You want your motion to look like other documents filed in the case.
- Insert the caption. The caption contains the name of the court, the names of each party, and the case number. It may also contain the judge's name. You can get all of this information from any document filed in your case.
- Remember a title. You can title your motion "Defendant's Response in Opposition to Plaintiff's Motion to Compel Discovery and For Sanctions" or something similar.[5]
- Add your introduction. In the introduction, identify yourself and state that you oppose the motion to compel. You can also briefly state your reasons why you oppose the motion to compel.[6]
- Sample language could read: "Defendant opposes Plaintiff's Motion for an Order To Compel on the grounds that (1) the documents requested are not relevant to the lawsuit and (2) certain relevant documents are protected from disclosure by the attorney-client privilege."
- Make your argument. In the body of your motion, you need to explain why you shouldn't have to comply with the discovery request. Make sure to support your argument with citations to the Rules of Civil Procedure (which govern discovery) and relevant court opinions as well.[7]
- For example, if you are refusing to turn documents over because they are not relevant, then remind the court of the rules regarding relevancy: "Rule 26(b)(1) limits discovery to any 'non-privileged matter that is relevant to any party's claim or defense.' If a party wants broader discovery, then it must show 'good cause' to support the request. Plaintiff has not shown any good cause in this case for requesting the past three years of Defendant's bank records."
- Add a conclusion. The conclusion can be brief. Simply repeat what you want the court to do. For example, you could write: "For the foregoing reasons, Defendant respectfully requests that this Court deny Plaintiff's Motion To Compel."[8]
- Sign the motion. Beneath the conclusion, add the words "Respectfully Submitted" and then insert a signature block underneath. The signature block should contain your name and contact information. Also add a date.[9]
- Obtain supporting declarations, if necessary. You can't make factual allegations in your motion unless they are supported by evidence. For example, you might be claiming that some documents are privileged because you sent them to your lawyer. In this situation, your lawyer will have to write a declaration identifying him or herself as your attorney.
- Include a certificate of service. You need to tell the court that you served a copy of your motion. Be sure to explain the method of service and the date service was made.
- Put the certificate on a separate sheet of paper titled "Certificate of Service" in all caps, bold.
- Sample language could read: "I hereby certify that on this 22nd day of April, 2016, I caused a copy of the foregoing Motion in Opposition to be served by first-class mail, postage prepaid, on counsel for plaintiff as follows," and then insert the name and address of counsel.[10]
- Sign your certificate.
EditFile the Motion - Make copies. Once you have completed your motion in opposition, you should make several copies of the complete motion (and any attachments or declarations). Make at least one copy for your records.
- Send a copy to the other side. Be sure to send your copy using the method identified in your certificate of service. Generally, you can mail a copy using first class mail.[11] Be sure to give the other side a copy of the motion sufficiently in advance of the hearing date.
- If there are additional parties in your lawsuit, then you can send them courtesy copies. For example, you might be one of two defendants. Send the other defendant a copy of your motion.
- File the original with the court. Take your copies and the original to the clerk and ask to file the original. You generally do not need to pay a fee to file your opposition motion.[12]

- Read all of the motions. After you filed your opposition, the other side might have filed a "reply" motion.[13] If so, there are now three motions. Reread them all closely.
- Sit in on a discovery hearing. If you have never argued a motion before the judge, you should try to sit in on a hearing. Pay attention to how much time the judge gives each side to speak and listen to the questions the judge asks.
- Listen to the other side's argument. Because the other side brought the motion to compel, they will argue first. Stand quietly and listen to what they say. Write down anything you think is wrong, so that you can correct the error when you get to speak.
- Also listen to the questions the judge asks. If the judge is more interested in one issue than another, you can lead off with that issue when it is your turn to speak.
- Argue your motion. Introduce yourself and who you represent. If you don't think the other side properly gave the background of the dispute, then quickly clarify, providing necessary detail before beginning your argument.
- You should limit your argument to your strongest two or three points. There probably won't be time to argue much more. Also leave time to correct any misimpression created by the other side.
- If the judge asks questions, then stand quietly and don't interrupt the judge. Also immediately answer the judge's question.
- Always call the judge "Your Honor."[14]
- Wait for the decision. After hearing argument, the judge should issue a decision from the bench. If you disagree, then you generally can't appeal until the case is completed. However, if the motion to compel affects a substantial right, then you might be able to appeal immediately.[15]
- For example, if you are a journalist, then you might have a statutory privilege not to be compelled to release the sources of your information. If the court tries to compel disclosure, then you might be able to bring an immediate appeal.

- Mix in the rice, and cook until golden brown. When the chiles, garlic, and onion are soft, stir 2 cups (370 g) of long-grain white rice into the pan. Allow it to cook until the rice grains become golden brown, which should take approximately 6 minutes.[5]
- Stir the rice occasionally while it's cooking to ensure that it doesn't burn.
- Stir in the tomato mixture, peas, and salt and pepper to taste. When the rice has turned golden brown, add the tomato and broth mixture, 1 cup (150 g) of frozen peas that have been thawed, and kosher salt and freshly ground black pepper to taste to the pan. Mix well so all of the ingredients are well blended.[6]
- You can also add a couple of carrots that have been peeled and cut into cubes to the rice if you desire.
- Reduce the heat and cook until the rice is tender. Lower the burner's heat to low, and allow the mixture to cook until the rice becomes tender and all of the liquid has been absorbed. It usually takes approximately 15 minutes for the rice to fully cook.[7]
- Be sure to cover the pan while the rice is cooking for the final time. That traps the steam, which helps cook the rice.
- Remove the pot from the heat and fluff the rice before serving. Once the rice is finished cooking, remove the pan from the heat and use a fork to gently fluff the rice. Next, transfer it to a serving dish and serve alongside your favorite Mexican main dish.[8]

Once you've stirred it twice and have ensured that the achiote powder has colored all of the rice, you can leave the dish to cook the rest of the way.[10]
- Allow the rice to cook until your cooker goes into the Warm or Keep Warm setting, which typically takes 15 to 20 minutes.
- Remove the rice from the rice cooker and serve. When your rice cooker indicates that the rice is done, transfer it to a serving dish or platter. Serve it alongside your favorite meat dish while still warm.[11]

- When you add the rice, you can also stir in up to 8 tablespoons (120 g) of bacon fat. That will help deepen the smoky flavor of the finished rice.
- Reduce the heat to low, cover, and cook until the liquid is absorbed. After the rice mixture has come to a boil, turn the burner's heat down to low and cover the skillet. Cook the rice until it is tender and all of the liquid is absorbed, which should take approximately 15 minutes.[16]
- If you don't have a lid for your skillet, you can place a baking sheet or a piece of foil across the top to help trap the steam.

How to Overcome Dizziness Posted: 24 Mar 2017 01:00 AM PDT Dizziness is a general, non-specific term often used to describe a variety of associated symptoms, such as feeling faint, lightheaded, nauseous, weak or unsteady. If your dizziness is creating the sense that you or your surroundings are spinning, then that is more accurately called vertigo.[1] Dizziness is a common reason for doctor visits and is certainly uncomfortable or annoying to experience, but it's unlikely to represent a serious, life-threatening condition. There are many ways to overcome dizziness at home, but be aware of the "red flags" that signal the need for medical intervention. EditOvercoming Dizziness at Home - Reduce your stress or anxiety. High levels of stress can cause changes in breathing rates and hormone levels, which can lead to dizziness or feelings of light-headedness and nausea. Certain anxiety disorders, such as panic attacks or various phobias also cause dizziness.[2] As such, reduce the stress and anxiety in your life as much as you can by communicating your feelings and trying to resolve relationship conflicts. Becoming less overwhelmed may reduce your dizzy spells.
- Sometimes a change of job, reduced hours, a different schedule or working more from home can reduce stress and anxiety issues.

- Fresh sweet fruit (especially ripe bananas and blueberries), fruit juice (especially sweetened apple or grape juice), white bread, ice cream and honey are all good foods to eat to quickly raise your blood sugar level.
- Conversely, constantly having too much sugar in the blood (hyperglycemia) can also cause dizziness due to dehydration and over-acidity.[6] Chronic hyperglycemia usually occurs in people with undiagnosed / untreated diabetes.
- Stand up slowly. Perhaps the most common cause of short-term bouts of dizziness, especially in the elderly, is a condition called orthostatic hypotension.[7] This condition occurs in people with relatively low blood pressure (particularly the systolic number) who stand up too quickly from a supine or seated position. As they stand up quickly, there is not quite enough pressure in the arteries that supply blood to the head to compensate fast enough, so the brain gets less oxygen than it needs for a few seconds or so. Chronically poor sleeping patterns are associated with higher levels of stress, hypertension, depression, diabetes and cardiovascular disease, all of which can cause dizziness to varying degrees.[8] Sleep disruption is linked to chronic anxiety, emotional / psychological trauma, chronic pain, caffeine use, over-medication, restless legs syndrome and many other issues, such as narcolepsy and sleep apnea (heavy snoring). As such, turn off the TV or computer and go to bed a little earlier and avoid caffeinated beverages (coffee, black tea, soda pop) at least 8 hours before bedtime.
- Sleeping late on the weekends is fine and may make you feel more rested and/or less dizzy, but you'll never be able to properly "catch up" on the sleep you lost during the work week.
- Natural sleep aids that you can take shortly prior to bedtime include chamomile tea, valerian root extract, magnesium (relaxes muscles) and melatonin (a hormone that regulates sleep and circadian rhythms).
- Avoid head trauma. Head trauma from car accidents and contact sports is a common cause of mild-to-moderate brain injuries, usually called contusions or concussions. The main symptoms of a concussion include dizziness, along with dull headaches, nausea, brain fog and ringing in the ears.[9] Head trauma tends to be cumulative, meaning it gets worse with each injury and builds over time, so try to reduce the risk or incidence of getting your "bell rung."
- Sports such as boxing, football, rugby and ice hockey are particularly risky for suffering significant head trauma.
- Always wear your seat belt while driving (prevents severe whiplash), and avoid activities that jar your head and neck such as bouncing on a trampoline, bungee jumping or going on roller-coaster rides.

As such, the build-up of mucous and other fluid can clog breathing passages and/or the inner ear, leading to dizziness and loss of balance. If that's the cause of your dizziness, then simply wait it out for a few days, keep hydrated and clear your sinuses by gently blowing into a tissue or rinsing them out with warm salt water.
- Plugging your nose and then trying to blow through it is a method of clearing out the narrow Eustachian tubes, which run from the throat to the middle ear. The tubes allow the equalization of pressure on each side of the eardrum, and dizziness or poor balance is often a consequence of having them clogged.[11]
- Other conditions often associated with dizziness include allergies, migraine headaches and anemia (low red blood cell count).[12]
- Get your blood pressure checked. As noted above, both low blood pressure (hypotension) and high blood pressure (hypertension) can cause dizziness, so get your family doctor to measure yours. In general, blood pressure should be below 120 (systolic) over 80 (diastolic).[13] Of the two conditions, hypertension is the more potentially dangerous and sometimes a symptom of heart disease. In fact, most serious issues with the heart, such as cardiomyopathy (diseased heart muscle), congestive heart failure and arrhythmia (irregular heart rhythms), cause hypertension and dramatically increase the risk of chronic, reoccurring dizziness.[14]

- You can buy blood glucose monitors from pharmacies, which require you to prick your finger for a blood sample. Without fasting, normal readings should be below 125 mg/dL for a general reference.
- Short-term hyperglycemia can also be caused by eating lots of refined sugar (called a sugar high or rush), which may lead to some dizziness.
- Get a referral to an ear specialist. If your dizziness is significant and disabling and best described as the world is spinning around you, then your may have vertigo. Vertigo may be due to benign positional vertigo (spinning feeling that occurs with head movements), labyrinthitis (an inner ear viral infection) or Meniere's disease (build up of fluid in the inner ear).[16] Essentially, vertigo results from a change in the balance mechanism in the inner ear (vestibular system) or in the connections of that mechanism to the brain. - Sometimes vertigo is severe enough to cause nausea, vomiting, headache and loss of balance for hours at a time.
- See an osteopath or chiropractor. Osteopaths and chiropractors are spinal specialists who focus on establishing normal motion and function of the small spinal joints that connect the vertebrae, called spinal facet joints. A relatively common cause of dizziness and vertigo is jammed / misaligned / dysfunctional joints of the upper neck, typically where it attaches to the skull.
